The writ petition is filed for a Mandamus declaring the action of the 2nd respondent in issuing proceedings in R.C.No.B.802/2014, dated 08-09-2014 suspending authorization of the petitioner’s fair price shop as illegal and arbitrary and for a consequential direction to set aside the said proceedings.

The case of the petitioner is that she was appointed as fair price shop dealer for Shop No.40 of Mallepalli village, Veldurthy Mandal, Kurnool District and since then, she has been distributing essential commodities to the cardholders without any complaint and her authorization is being renewed from time to time valid up to 31-03-2016. While so, basing on the report of the 3rd respondent-the Tahsildar, Veldurthy Mandal dated 01-09-2014 stating that certain irregularities have been committing by the petitioner, the 2nd respondent issued proceedings in R.C.No.B.802/2014, dated 08-09-2014 suspending the authorization of the petitioner pending enquiry. Challenging the said proceedings, the petitioner preferred an appeal before the 5th respondent-Joint Collector, Kurnool along with stay petition, but no orders are passed thereon. Aggrieved by the same, the present writ petition is filed.
3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies.
4. Learned counsel for the petitioner submits that the authorization of the petitioner’s fair price shop was suspended on vague grounds and the petitioner has preferred an appeal before the Joint Collector, Kurnool, but no orders are passed thereon.
5. Since it is stated that a statutory appeal is filed by the petitioner before the 5th respondent-Joint Collector, Kurnool along with stay petition, which is pending before him, the 5th respondent- Joint Collector, Kurnool is directed to dispose of the appeal pending before him, as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of the order. Till disposal of the appeal, the impugned proceedings dated 08-09-2014 shall remain suspended.
With the above direction, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending, shall stand closed.
