Order:
This Writ Petition is filed for the following substantive relief:
“to issue a writ of Mandamus or any other appropriate writ or order declaring the action of the Respondents in demanding from the petitioner the electricity charge at three times the normal rates for the period commencing from the release of electricity supply to his premises under the bills, dated 03- 11-2014, of respondent no.2 basing on G.O.Ms.No.86, dated 03-03-2006, as illegal and unconstitutional and to restrain the respondents from raising bills by raising three times the electricity charges and insisting for payment of the same from the petitioner for service connection Nos.D3006206, D3006207, D3006208, D3006209, D3006210, D3006211 (single Phase) and D3006212 (Three phase) at house bearing No.1-2-606/148/A/1 at B.M.Nagar, Kawadiguda, Hyderabad.”
At the hearing, it is not disputed by the learned Counsel for both the parties that the issue similar to that raised in this Writ Petition viz., demanding more electricity consumption charges than the tariff stipulated by the APERC only on the ground that the petitioner did not secure Occupancy Certificate from the Greater Hyderabad Municipal Corporation of Hyderabad, was decided by this Court vide W.P.No.32906 of 2014, dated 05.11.2014.
For the same reasons as contained in the aforesaid order, this Writ Petition is allowed in part with the direction that the reasons and directions contained therein shall form part of this order.
As a sequel, WPMP.No.44146 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
