JUDGMENT / ORDER

This revision petition challenges the eviction order passed by the learned District Munsif Cum Judicial Magistrate, Vedharanyam in E.P.No.7 of 2016 in RCOP.No.5 of 2012 dated 19.10.2016.

2. The learned counsel for the petitioner fairly brought to the notice of this Court that the petitioner filed an appeal along with delay application before the Rent Control Appellate Authority, Sub Court, Nagappattinam against the order passed in RCOP. The said condone delay application was allowed on payment of cost and the petitioner also has complied the conditional order. Now the appeal has been numbered as RCA No. 1 of 2017 and pending before the Sub Judge, Nagapattinam.
3. In view of the above, I am not inclined to entertain the present Civil Revision Petition. However, this order will not stand in the way of the petitioner to approach the Executing Court for filing necessary applications, if permissible under law. In view of the facts and circumstances of the case, this Civil Revision Petition is dismissed with the above observations. No costs. Connected miscellaneous petition is also dismissed.
