Southern Law Associates, Advocate R2) ...Respondents This Regular First Appeal is filed under sec.96 of CPC against the judgment and decree dated 24.03.201 passed in OS No.1652/2002 on the file of the XLIII Additional City Civil and Sessions Judge, CCH-44, Bangalore partly decreeing the suit for the partition and separate possession in respect to plaintiff No.2 and partly dismissing the suit with respect to plaintiff No.1 This appeal coming on for Orders this day, the court delivered the following:
J U D G M E N T The learned counsel appearing for the parties submit that the dispute between the parties have been settled. A memo has been filed to that effect. The memo is signed by the parties and their learned counsel. In the memo stated that at the intervention of relatives, friends, elders and well-wishers, the parties have settled their dispute by entering into an agreement on 9th March 2017 and decided to sell Schedule A and B properties and divide the sale consideration received from the prospective purchasers among themselves in the ratio mentioned in the agreement dated 9th March 2017. Memo is placed on record. In the light of the submission and also in the light of the memo filed, this appeal stands disposed of in terms of the memo.
