JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) WEDNESDAY, THE NINTH DAY OF JULY TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.15750 of 2014 BETWEEN S.V. Narasinga Rao and others.
... PETITIONERS AND The District Collector, Visakhapatnam District and another.
...RESPONDENTS Counsel for the Petitioners: MR. G. RAMA GOPAL Counsel for the Respondents: GP FOR REVENUE (AP) The Court made the following:
ORDER:
Heard learned counsel for the petitioners and learned Assistant Government Pleader for respondents.
2. Petitioners claim that their mother is the absolute owner and possessor of 427 sq. yards of land in Sy.Nos.129/1 & 2 and 128/4 of Chanukya Nagar bearing Dr.No.5-4-11 by virtue of a registered sale deed dated 19.08.1989 and petitioners claim title to the said land as legal heirs. Petitioners state that their mother applied for regularization of the house plot under LRS Application No.32046 dated 29.06.2012 and for the purpose of consideration of the said application, since the Visakhapatnam Urban Development Authority insisted on obtaining No Objection Certificate (NOC) from the concerned Mandal Revenue Officer, the mother of the petitioner applied to the second respondent for NOC under transaction ID.No.T122936541 dated 03.09.2012. Alleging that in spite of several remainders and requests, no action is taken for the purpose of issuing NOC, the present writ petition is filed.
3. Learned Assistant Government Pleader has secured instructions wherein it appears that the second respondent claims the said land in Sy.No.129/1 as Government land and it is stated that on 06.10.2012 a rejection memo was stated to have been sent to the petitioners with reference to their application.
4. Learned counsel for the petitioners, however, state that the petitioners have not received any such rejection order.
In view of the rejection of the application of the petitioners for grant of NOC, the writ petition is disposed of directing the second respondent to furnish a copy of the said rejection dated 06.10.2012 to the petitioners under his acknowledgement and thereafter, the petitioners shall be at liberty to take appropriate steps in accordance with law. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
