The learned counsel for the appellant made an endorsement indicating that he is withdrawing the intra court appeal with liberty to make a fresh application, in case there is a threat to his life.

In view of the endorsement made by the learned counsel for the appellant, the intra court appeal is dismissed as withdrawn with liberty to make a fresh application, in case there is a serious threat to the life of the appellant. We also make it clear that in the event of making any such application by the appellant, the same shall be considered and disposed of by the appropriate authority, on merits and as per law, uninfluenced by any of the observations contained in the order impugned in this appeal. No costs.
