ORDER: (per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta)
The Deputy Superintendent of Police has submitted a report in consultation with the officials of the Pollution Control Board and the Mosque people and also the petitioners. We have seen the report and it is clear and accurate, and it suggests that the decibel level of the sound shall be less than 65 dB(A) in case of Azan, which is the shorter duration. However, in case of Namaz on Fridays, i.e. longer duration, the decibel level of the sound must not exceed 55 dB(A). It appears from the report that the Mosque people have agreed to the aforesaid decibel level of sound.
Accordingly, we direct the Pollution Control Board, Police Authority and Mosque people to see that decibel level of the sound as above is maintained strictly without fail. In case of breach, it would be open for the police officials to take steps in accordance with law.
The Writ Petition is accordingly closed. No order as to costs.
Consequently, miscellaneous petitions, if any pending, shall stand closed.
