ORDER:
This writ petition is filed for the following substantive relief:
“…to issue a writ, order or direction, more particularly a Writ of Mandamus, declaring the action of the 1st Respondent in issuing the proceedings No.9280/E3/BDS/2011, dated 19.09.2011 and the consequential order passed by the 2nd Respondent discharging the petitioner from the B.D.S.Course as arbitrary, illegal, improper and violative of Article 14 of the Constitution of India and further direct the Respondents to permit the petitioner to appear for the examinations of her backlog subjects in the forthcoming examinations to be held in June 2012 or any other consequent date and also permit the petitioner to attend the classes for the 2nd Year B.D.S Course in the 2nd Respondent‘s college.”
After arguing the case, Smt.Jyothi Eswar Gogineni, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition with liberty to his client to file a fresh writ petition by questioning the Regulations of Dental Council of India.
Accordingly, the writ petition is dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the writ petition, interim order, dated 16.05.2012, shall stand vacated and W.P.M.P.Nos.18231 and 48843 of 2012 shall stand disposed of as infructuous.
