JUDGMENT / ORDER

Aggrieved over the return endorsement made on 06.09.2017 in S.R.No.12382 of 2017 in E.A.No.4 of 2017 in O.S.No.234 of 1994, the petitioner is before this Court.
2. The petition made by the petitioner in Unnumbered S.R.No.12382 of 2017 in E.A.No.4 of 2017 was returned on 06.09.2017 with the following endorsement:
"06.09.2017:
The Scheme Court has approved the amendment. The Hon'ble High Court has directed to dispose off the appointment of member of Education Committee within three months. Hence this petition is returned."
3. The learned Senior Counsel appearing for the petitioner would submit that the time limit for appointment of Member of Education Committee expires by 11.11.2017. Further, the matter is posted for hearing on 03.10.2017. Since there is enough time to dispose of the execution application, returning the petition made by the petitioner is unjustified and unwarranted.
4. Considering the submissions made by the learned Senior Counsel for the petitioner, a direction is issued to the Scheme Court / Principal Subordinate Judge, Mayiladuthurai, to dispose of E.A.No.4 of 2017 on merits and in accordance with law, on 03.10.2017 itself, before appointing Member of the Education Committee.
5. With the above observation and direction, the Civil Revision Petition is disposed of. No costs. Consequently, connected civil miscellaneous petition is closed.
