Heard learned counsel for the petitioner and the learned standing counsel.
It is urged that appropriate direction be issued to respondent no.2 to decide restoration application no. 94, pending since 1993 in Case No.65/47/45 (Harihar Sharan vs. Ganesh), under Section 176 of the U.P. Z.A & L.R Act, within a stipulated period.
It is not disputed by learned counsel for the petitioner that the court of the Presiding Officer concerned is lying vacant.
Learned standing counsel submits that no useful purpose would be served by keeping this petition pending, it be disposed of by giving appropriate direction to the Collector concerned.
Admittedly, the court concerned is lying vacant. No orders for expedite can be passed at this stage. However, liberty is granted to the petitioner to approach the Collector, Deoria along with a certified copy of this order in respect of redressal of his grievance, which shall be duly addressed, as expeditiously as possible, preferably within 2 months from the date of production of the certified copy of the order, in accordance with law.
