For Petitioner : Mr.S.Senthil Murugan For respondent : Mr.C.Emalias, Addl. Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the respondent police to investigate the case and file a final report in Crime No.476 of 2016 within a stipulated time.
2. It is the case of the petitioner that as against one Saiyad Basha and three others, he lodged a complaint with the respondent police and on receipt of the same, the respondent police issued CSR as CSR No.154 of 2016. Thereafter, since the respondent failed to take appropriate action against the accused persons, the petitioner filed a private complaint before the learned Judicial Magistrate, Perambalur, seeking a direction to the respondent police to register a case as against the accused persons and the learned Magistrate directed the respondent to register a case based on the complaint given by the petitioner. Thereafter, the respondent registered a case in Crime No.476 of 2016 for the offence punishable under Sections 447, 294(b), 506(i) and 379 I.P.C. Even after registration of the said case, the respondent has not taken any action to investigate the case and file final report. Hence, the present petition.
3. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor submitted that the investigation in Crime No.476 of 2016 has already been completed and the final report is yet to be filed.
4. In view of the said submission made by the learned Additional Public Prosecutor, this Court directs the respondent to file final report in Crime No.476 of 2016 within a period of six weeks from the date of receipt of a copy of this order. The Criminal Original Petition is ordered accordingly.
