This contempt case is filed to punish the respondent/contemnor for willful disobedience of the order dated 03.11.2008 passed in W.P.No.24805 of 2007 by this Court.
2. Earlier, the present petitioner filed C.C.No.1529 of 2009 for the same relief and the said contempt case was dismissed by this Court on 28.10.2013 with the following observations:
“The order dated 03.11.2008 has been complied with by the respondents, which resulted in identification of documents required by the petitioner, but now, the petitioner seeks a direction to the respondents to make him available the documents identified by him. The request of the petitioner is beyond the purview of the contempt proceedings and falls under the domain of the provisions of the Act of 2005. The order of this Court dated 03.11.2008 has been complied with by the respondents and the respondents have categorically stated that they would supply the required documents as and when an application is received by them.”
3. In view of the finding recorded earlier with regard to implementation of the order dated 03.11.2008 in W.P.No.24805 of 2007, the present contempt case is not maintainable and is accordingly dismissed. No costs.
