The petitioner is aggrieved by the order passed by the second respondent whereby the petitioner's flour mill has been closed on the ground of the noise, smoke and air pollution.
A short counter affidavit has been filed on behalf of respondent no. 1, wherein it is stated that on 26.04.2013, the impugned order challenged in the writ petition dated 13.03.2013 has been cancelled and withdrawn.
We have heard learned counsel for the petitioner and Dr. H.N. Tripathi, learned counsel for the respondents.
In view of the said fact, the cause of action does not survive.
Accordingly, the writ petition is dismissed as infructous.
