2. Heard the learned counsel appearing for the petitioner and learned Government Advocate (Crl.side) appearing for the respondent.
3. Learned counsel for the petitioner submits that no Mistake of Fact notice has been served on the petitioner till date. Hence, the petitioner has filed the present petition.
4. In such circumstances, this Court direct the respondent Police serve the Mistake of Fact notice to the petitioner, and this Court closed this petition giving liberty to the petitioner to prefer a private complaint.
5. Recording the said submission, the criminal original petition is closed.
