ORDER:
The petitioners were appointed as casual drivers under One Time Recruitment process on 28.12.2003 and they have been continuing in service since then. It is submitted that as per the Regulations of the APSRTC, the services of the petitioners have to be regularized. It is further submitted that seniority list of drivers and conductors was also prepared on 16.09.2007 which contains the names of the petitioners and that there are 226 vacancies as on 16.08.2006. Nextly it is submitted that in other regions, services of similarly placed employees were regularized, but the services of the petitioners have not been regularized. The petitioners relied on the judgment of this Court in Writ Petition No. 14783 of 2010 and Batch pertaining to D.Rajaiah and others, wherein regularization of services of the petitioners therein with effect from the date of their initial appointment has been directed in terms of G.O.Ms.No. 285, dated 05.10.2007. Under the aforesaid circumstances, the present Writ Petition is filed seeking a direction to the respondents to consider the case of the petitioners for regularization of their services as Drivers with effect from 16.08.2007.
I have heard learned Counsel for the petitioners and learned Standing Counsel appearing for the APSRTC. In the other regions the services of the employees who are similarly placed have been regularized having recourse to G.O.Ms.No.285, dated 05.10.2007, but the case of the petitioners was not considered for regularization of their services. They also submitted a representation to the respondents on 28.05.2014 seeking to consider their case for regularization and the said representation is pending consideration.
Under these circumstances, the respondents are directed to consider the representation of the petitioners dated 28.05.2015 for regularization of their services in terms of the circular instructions within a period of four months from the date of receipt of a copy of this order.
Subject to the above direction, the Writ Petition is disposed of at the admission stage. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
