Date : 20/07/2012 ORAL JUDGMENT The petitioner filed the present petition as he was aggrieved by his non-consideration for promotion to the post of Mamlatdar. He prayed that the respondent be directed to consider him for promotion to the post in question along with one Mr. R.P. Shah and Mr. M.I. Achhawa and all other Deputy Mamlatdars who initially joined services on or after 03.09.1965, being the date when the petitioner had also joined the services.
2. When the petition was posted for hearing today, learned advocate Mr.
G.M. Joshi for the petitioner stated before the Court that the petitioner has already retired. In that view, it could not be disputed, in the facts of the case, that the petition has become infructuous due to passage of time and in view of intervening retirement of the petitioner.
3. In light of above, the petition is dismissed as having become infructuous. Rule is discharged. Interim relief, if any, stands vacated. No order as to costs.
