COMMON ORDER:
This writ petition was filed by Smt. J.V. Madhavi, learned counsel, on behalf of the petitioner seeking a writ of Mandamus declaring conversion of the service connection into H.T. Category-I based on the report of the Divisional Engineer, DPE, Vijayawada, as illegal and arbitrary.
2. This Court, by order dated 14.09.2007, granted interim stay subject to condition of the petitioner depositing half of the charges in the bill for the month of July 2007.
3. The petitioner filed W.P.M.P. No.18675 of 2013 stating that subsequent to passing of the interim order he negotiated with the respondent authorities who promised to consider the issue, but insisted for withdrawal of the writ petition. Thereafter, he approached the office of his counsel for taking steps for withdrawal of the writ petition and he noticed that the office of his counsel was closed and in spite of his best efforts, her whereabouts were not known. Since the respondents are unable to settle the matter due to pendency of the writ petition, he filed the present application seeking permission to withdraw the writ petition as not pressed.
4. However, the party-in-person is absent. But, in view of the averments made in the sworn affidavit by the party- in- person, the W.P.M.P. No.18675 of 2013 is ordered and the writ petition is dismissed as withdrawn. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
