Petition under Section 24 of C.P.C. to withdraw H.M.O.P.No.268 of 2017 pending on the file of Sub-Court, Poonamallee, and transfer the same to I Additional Family Court, Chennai.
For petitioner : Mr.A.Arulmozhi O R D E R Husband has filed this Transfer C.M.P., for transferring H.M.O.P.No.268 of 2017 on the file of Sub-Court, Poonamallee, filed by him for divorce against the respondent-wife, to the file of I Additional Family Court, Chennai.
2. According to the petitioner, the respondent-wife has filed O.P.No.2667 of 2017 on the file of I Additional Family Court, Chennai, for restitution of conjugal rights, and, in order to have a joint trial and to avoid inconvenience to him, transfer of H.M.O.P.No.268 of 2017 from Sub-Court, Poonamallee, to I Additional Family Court, Chennai, is necessary.
3. In the considered opinion of this Court, the prayer of the petitioner is reasonable. Therefore, H.M.O.P.No.268 of 2017, pending on the file of Sub-Court, Poonamallee, is withdrawn and transferred to I Additional Family Court, Chennai, to be tried along with O.P.No.2667 of 2017, pending on its file.
4. Transfer C.M.P. is allowed. Consequently, the connected C.M.P.No.15150 of 2017 is closed.
