CONTEMPT CASE No.529 of 2014 and WRIT PETITION No.5813 of 2014 COMMON ORDER:
This Contempt Case No.529 of 2014 is filed under Sections 10-12 of Contempt of Courts Act to punish the respondents for their willful and deliberate disobedience of the orders of this Court dated 28.02.2014 in W.P.No.5813 of 2014 under the provisions of the Contempt of Courts Act, 1971.
This Writ Petition No.5813 of 2014 is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the first respondent in reverting the petitioners from the post of Assistant Engineer to Sub-Engineer vide Memo No.CGA(HRD)/GM(Adm)/AS(Per)/PO-A/75- A1/2010-10, 11,12,13 dated 15.02.2014 respectively as illegal, unjust, arbitrary and discriminatory, without jurisdiction and in violation of principles of natural justice and also in violation of Articles 14 and 21 of the Constitution of India apart from contrary to the APSEB Regulations with particular reference to Regulation No.25(a) of Part-II of APSEB Regulations and consequently set aside the Memo dated 15.02.2014 with all consequential benefits.
Heard the learned counsel appearing for the petitioners and the learned counsel appearing for the respondents in both the cases.
Since the order which is said to be violated has been complied with and the reversion order of the petitioner is cancelled, the writ petition and the contempt case are closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in these cases shall stand closed.
It is submitted by the learned counsel appearing for the petitioner that the petitioner has not been paid salary from February, 2014. If really that is so, the petitioner may make a representation to the respondents and the respondents are directed to consider the said representation and pass appropriate orders thereon in accordance with law.
