Respondents Habeas Corpus Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus of any other appropriate writ or directing the respondents 1 to 3 herein to produce Mr.Saravana Kumar, S/o late Mathavaraji, aged about 38 years, residing at No.56/15, Pandian Street, Perungalathur, Chennai – 600 063 before this Court and set him liberty.
For Petitioner : Mr.W.M. Abdul Azeez For Respondents : Mr.V.M.R. Rajentren Additional Public Prosecutor ORDER (Order of the Court was made by S. NAGAMUTHU,J.,) The petitioner is the wife of one Mr.Saravanakumar, aged about 38 years. According to the petitioner, the said Saravanakumar has been found missing from 21.02.2017 onwards. Since he has not been secured, the petitioner has come up with this habeas corpus petition.
2. It is submitted by the learned Additional Public Prosecutor that Mr.Saravanakumar had raised loan from various persons, running to Rs.2 ½ crores and since there was pressure from the creditors, he has gone underground and however, search is still in progress.
3. In view of the same, we find that there is no illegal detention. Therefore, we are unable to grant any relief sought for by the petitioner. Hence the Habeas Corpus Petition is dismissed. However, the respondents are directed to continue the search of the detenu.
