ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
This Writ Petition was filed for declaration that the investigation by the fourth respondent in Crime No. 77 of 2008 was not proper and consequently to entrust the same to CBCID.
This Court by order dated 17.11.2008 directed the second respondent to consider and dispose of the representation purported to have been filed by the petitioner on 23.08.2008 and issue appropriate directions as required under the law.
The fourth respondent filed a counter affidavit stating that crime No. 77 of 2008 was investigated and during the investigation it has come out that the offence was committed by three persons and they were arrested and later remanded to judicial custody. After completion of investigation, a charge sheet was filed before the competent Court and the same was taken on record in CC.No. 383 of 2008. It was further stated that by judgment dated 2.2.2009 the accused were convicted.
In view of the aforesaid averments in the counter affidavit, the cause of action in the Writ Petition does not survive for consideration and therefore the Writ Petition is liable to be dismissed.
Accordingly the Writ Petition is dismissed. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
