Heard learned counsel for the parties.
The petitioner questions the memo dated 3.9.2013 issued by the 6th respondent and also the memo dated 29.11.2013 issued by the 4th respondent whereby the request of the petitioner for conducting survey and demarcation of land admeasuring Ac.13-00 in Sy.Nos. 19 and 45 situated at Dornalpalli village, Doma Mandal, Ranga Reddy district was rejected on the ground that tippans and sub-division records are not available. It is contended by the learned counsel for the petitioner that if the said documents are not available with the respondents, they can be obtained from the appropriate authorities and request of the petitioner cannot be rejected on the said ground. Reliance is also placed by him on an order dated 29.4.2014 passed by this Court in W.P.No. 14215 of 2014 wherein similar rejection was not approved by this Court and a direction was given to the authorities to conduct survey and pass appropriate orders.
Learned Government Pleader for Revenue submits that if the petitioner approaches the respondents 4 and 6 with appropriate application for survey and demarcation of the land in question, by paying necessary fee, the said application would be reconsidered after obtaining tippans and records from the Director of Survey and Land Records, if not available with the fourth respondent.
In the circumstances, the writ petition is disposed of permitting the petitioner to approach the respondents 4 and 6 with an appropriate application for conducting survey and demarcation of land in question, if required by paying necessary fee and shall comply with all other requirements as per Rules. The respondents 4 and 6 shall thereafter consider the petitioner’s application and pass appropriate orders in accordance with law within four months from the date of receipt of a copy of this order, after issuing notice to all the affected parties. Miscellaneous applications, if any, shall stand closed. No costs.
