ORDER:
This writ petition is filed for the following substantive relief:
“…to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd respondent in cancelling the petitioner’s authorization of the Fair Price Shop No.35 of Utakallu Village, Gooty Mandal, Anantapuramu District vide proceedings Rc.D.D1CS/3829/2014 dated 20.10.2014 even though the variations shown are within permissible limits and exempted under the Andhra Pradesh State Public Distribution System (Control) Order, 2008, as illegal, arbitrary and violation of principles of natural justice and consequently set aside the same, by permitting the petitioner to supply the commodities to the cardholders of Fair Price Shop No.35 of Utakallu Village, Gooty Mandal, Anantapuramu District.”
In obedience to the notice issued by this Court, the incumbent of respondent No.3 is personally present. He has stated that on realizing his mistake in passing the impugned order, he has restored the petitioner’s fair price shop authorization vide proceedings in Rc.D1CS/8844/2014 dated 17.11.2014. He has also submitted to the Court that further action against the petitioner on the charges mentioned in the impugned order is deemed to have been dropped and that he will not proceed with the further enquiry on the said charges.
The above submissions of respondent No.3 are placed on record and the writ petition is disposed of in view of the corrective steps taken by him.
As a sequel to the disposal of the writ petition, W.P.M.P.No.41913 of 2014 shall stand disposed of as infructuous.
