When the matter is taken up for hearing, none appears for the petitioner. Learned counsel for the respondents 1 to 6 stated that the main suit O.S.No.5 of 2009 itself is withdrawn, as such, the Civil Revision Petition has become infructuous since the same is filed being aggrieved by the order dated 30-04-2010 in I.A.No.10 of 2009 in O.S.No.5 of 2009. Learned counsel for the respondents also produced a copy of the order dated 23-08-2013 in O.S.No.5 of 2009 passed by the learned Principal Junior Civil Judge, Nizamabad, wherein the suit is withdrawn.
Recording the said submission, the Civil Revision Petition is dismissed as infructuous. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
