The petitioner was granted approval by the NCTE for D.El.Ed. Course in the year 2017. The petitioner has made an application for affiliation before the respondents no. 1 and 2.
The submission of Sri Shamim Ahmad, learned counsel for the petitioners, is that the petitioner institution be granted affiliation for D.El.Ed. Course for the academic Session 2019-20.
Learned Standing Counsel submits, that grant of affiliation by the State Government for D.El.Ed. Course, would require verification of facts and due diligence by the State authorities. It has to be ascertained, whether the last date for grant of such affiliation has expired or not.
Be that as it may, these are matters of fact which needs to be verified by a competent authority.
Matter is remitted to respondent no. 2, Secretary, Pariksha Niyamak Pradhakari, Uttar Pradesh, Allahabad, to decide the representation of the petitioner, preferably within a period of two months, from the date of receipt of a certified copy of this order, for the Session 2019-20, in case the petitioner is found eligible.
The Court has not gone into the veracity of the assertions in the writ petition nor has the claim of the petitioner been judged on merits. It is for the competent authority to do so after independent application of mind.
The writ petition is disposed of.
