Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to consider the petitioner's representation dated 20.03.2004 and to grant lease for a further period of five years in respect of stone quarry situated in Survey No.548 (South part), Myvadi Village, Udumalpet Taluk, Coimbatore District measuring about an extent of 1.25.0 hectares, pursuant to the amended sub-rule 8 of Rule 8 of the Tamil Nadu Minor Mineral Concession Rules, 1959.
For Petitioner : Mr.S.Muthukumar For Respondent : Mr.V.Jayaprakash Narayanan Special Government Pleader O R D E R The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondent to consider the petitioner's representation dated 20.03.2004 and to grant lease for a further period of five years in respect of the stone quarry situated in Survey No.548 (South part), Myvadi Village, Udumalpet Taluk, Coimbatore District measuring about an extent of 1.25.0 hectares, pursuant to the amended sub-rule (8) of Rule 8 of the Tamil Nadu Minor Mineral Concession Rules, 1959.
2. The issue raised in this writ petition is squarely covered by the decision of the Hon'ble Full Bench of this Court reported in 2011 (5) CTC 577 (C.Muthukrishnan Vs. The District Collector, Tirunelveli District, Tirunelveli and another), wherein, it has been categorically held that after expiry of the lease period, there is no matter of right for extending further period of lease.
3. Hence, this writ petition is dismissed as nothing survives for adjudication in this writ petition. No costs. Consequently, the connected miscellaneous petition is also closed.
