JUDGMENT / ORDER

Respondents Writ Petition has been filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the 1st respondent to implement the order of the Director of School Education in his Proc.Na.Ka.No.18533/G6/03 dated 10.03.2004 immediately and grant all the monetary and service benefits with effect from 03.06.1997.
For Petitioner :Mr.R.Singaravelan, SC for Mr.S.Jagadeesan For Respondents :Mrs.M.E.Raniselvam, AGP for R1 O R D E R This writ petition has been filed by the petitioner seeking to direct the 1st respondent to implement the order of the Director of School Education in his Proceedings vide Na.Ka.No.18533/G6/03, dated 10.03.2004 and to grant all the monetary and service benefits to the petitioner with effect from 03.06.1997.
2. Earlier, at the admission stage itself, this Court by order dated 26.08.2004 disposed of the writ petition by giving direction to the 1st respondent to implement the order passed by the Director of School Education. Subsequently, the 2nd respondent filed a petition seeking to recall the said order dated 26.08.2004 alleging that without hearing them, the writ petition was allowed. Therefore, the writ petition has been restored on file.
3. Heard both sides. Admittedly, the 2nd respondent is the subordinate of the Director of School Education, who has passed an order dated 10.03.2004 sought to be implemented. Hence, the first respondent is directed to consider the petitioner's claim as per order of the Director of School Education dated 04.04.2003, if no order has not been passed till date, within a period of 8 weeks from the date of receipt of a copy of this order.
With the above direction, the writ petition is disposed of. No costs.
