JUDGMENT / ORDER

The petitioner, who is the wife of the respondent, has filed the above Tr.C.M.P. to withdraw the Original Petition in F.C.O.P.No.157 of 2016 pending on the file of Family Court, Vellore and to transfer the same to Sub Court, Hosur, Krishnagiri District.
2. In the affidavit filed in support of the petition in para 5, the petitioner-wife has stated that she is residing at Hosur along with her parents, therefore, the Original Petition in F.C.O.P.No.157 of 2016 should be transferred to the file of Sub Court, Hosur, Krishnagiri District.
3. The respondent-husband filed his counter disputing the averments stated in the affidavit filed in support of the petitioner and in para 3, he has stated that the petitioner is working in Cognizant Technology Solutions (CTS), MEPZ, Tambaram, Chennai and and she is staying at Chennai in a rented house.
4. The learned counsel appearing for the petitioner also submitted that the petitioner-wife is now working at Chennai in the said company.
5. The learned counsel appearing on either side submitted that since the petitioner is residing at Chennai, the Original Petition in F.C.O.P.No.157 of 2016 pending on the file of Family Court, Vellore can be transferred to the file of Family Court, Chennai.

In view of the above, by consent of both the parties, the Original Petition in F.C.O.P.No.157 of 2016 pending on the file of Family Court, Vellore is withdrawn and transferred to the file of Family Court, Chennai. The parties are at liberty to file appropriate applications before the Family Court, Chennai for dispensing with their personal appearance. The learned counsel for the petitioner submitted that the Family Court, Chennai may be directed to dispose of the matter within a time frame. Having regard to the submissions made by the learned counsel on either side, the Family Court, Chennai is directed to dispose of the Original Petition in F.C.O.P.No.157 of 2016 on merits and in accordance with law, within a period of nine months from the date of receipt of the papers from the file of Family Court, Vellore.
With these observations, the Tr.C.M.P. is disposed of. No costs.
Consequently, connected miscellaneous petition is closed.
