ORDER:
This writ petition is filed for the following substantive relief:
“…to issue any appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in discharging the petitioner from the B.D.S.Course orally, as illegal, arbitrary, unreasonable, violation of Article 14 of the Constitution of India and also in violation of principles of natural justice and contrary to the settled principles of law laid down by the Hon’ble Constitutional Courts and consequently direct the respondents to permit the petitioner to appear for Supplementary examination i.e., General Anatomy by allowing the petitioner to attend the classes of 2nd year B.D.S.Course.”
After arguing the case, Sri M.Viswanadham, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition with liberty to his client to file a fresh writ petition by questioning the Regulations of Dental Council of India.
Accordingly, the writ petition is dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the writ petition, W.P.M.P.No.37955 of 2014 shall stand disposed of as infructuous.
