By means of this writ petition the petitioner is claiming to fill up Class-IV post in the institution.
Regulation 101 Chapter III of the regulations framed under the U.P. Intermediate Education Act, 1921 was amended and it was provided that the said post will be filled through outsourcing. That amendment was quashed by the High Court by the judgment in the case of Principal, Abhay Nandan Inter College, Vishnu Mandir and another Vs. State of U.P. and others, reported in 2019(4) ADJ 819 (DB). It appears that the State has filed a S.L.P. before the Supreme Court and by order dated 13.8.2019 the decision of the Principal, Abhay Nandan Inter College, Vishnu Mandir and another Vs. State of U.P. and others has been stayed. That means now the appointment can be made only through outsourcing as per the amendment in Regulation 101.
Considering the aforesaid subsequent development, learned counsel for the petitioner does not wish to press this writ petition and seeks liberty that when the law is clarified by the Supreme Court, if so required, may file a fresh writ petition.
With the aforesaid liberty, the writ petition is dismissed.
