N., SPP) This petition is filed under Section 439 Cr.P.C., praying to enlarge the petitioner on bail in Cr.No.01/2019 of ACB Police (Vidhana Soudha Police Station) for the offence punishable under Sections 7 and 8 of Prevention of Corruption Act and etc.
This petition coming on for Orders, this day, the Court made the following:
ORDER Learned counsel for the petitioner has filed a memo for being spoken to. In the said memo it is stated that after hearing the matter, the case was reserved for judgment on 06.03.2019. In the meanwhile, on 14.03.2019 the trial Court has enlarged petitioner-accused on statutory bail under Section 167(2) of Cr.P.C. Hence, the relief claimed in the petition has become infructuous. On these grounds, he prayed to dismiss the petition as not pressed.
Memo is taken on record.
As petitioner-accused has already been released on statutory bail under Section 167(2) of Cr.P.C., the present petition does not survive for consideration. Hence, the same is dismissed as having become infructuous.
