JUDGMENT / ORDER

The petitioners have approached the Revenue Divisional Officer. The Revenue Divisional Officer passed Ext.P6 order, which is produced as Ext.P6 in W.P.(C) No.15578 of 2013. According to the petitioners, certain persons are interfering with the way being used by the petitioners and using it for drinking and also causing nuisance. The Revenue Divisional Officer passed Ext.P6 order produced in W.P.(C) No.15578/2013 directing to put up a gate with lock and keep the keys of lock one with the petitioner and the other with the party respondents. It is challenging the above order, the writ petitions are filed by both parties. According to the both parties, the order passed by the Revenue Divisional Officer is unsustainable.
W.P.(C) Nos.15578 & 17909 of 2013 2 2. It is contended by the learned counsel for the petitioner in W.P.(C) No.17909 of 2013 that the dispute is a civil nature and the Revenue Divisional Officer has no jurisdiction. It is contended by the writ petitioners in W.P.(C) No.15578 of 2013, they must be given exclusive use of key.
Considering the facts and circumstances, I am of the view that the dispute is between the petitioners, who have filed these writ petitions. This is essentially a civil dispute. In view of the above, Ext.P6 is quashed. The parties are free to approach the civil court, if any dispute subsists between them.
These writ petitions are disposed of as above. No costs.
