The case of the petitioner is that the fifth respondent has started a sawmill in front of his house bearing Door No.27-267, Kosuvaripalle Road, Mudivadu Village and Post, Kurabalakota Mandal, Chittoor District. Due to the usage of heavy machinery, it is causing huge noise and dust pollution resulting in health hazards. Hence, the petitioner gave a complaint dated 22.11.2011 to the respondent authorities. Even though the third respondent addressed a letter dated 18.08.2012 forwarding the complaint to the fourth respondent, no action has been taken so far. Aggrieved by the same, the present writ petition is filed.
Heard the learned counsel for the petitioner.
The learned Assistant Government Pleader for Forests submits that the unit established by the fifth respondent does not come within the definition of ‘sawmill’, as such no action was taken.
In view of the same, since the respondent authorities are stating that the unit established by the fifth respondent does not come within the definition of ‘sawmill’, no direction can be granted in this case. If the fifth respondent is causing pollution, nuisance and health hazards, it is open for the petitioner to initiate appropriate proceedings against the fifth respondent as per law. If the same is initiated, the authorities concerned may take appropriate action as early as possible.
With the above observations, the Writ Petition is disposed of.
There shall be no order as to costs.
The miscellaneous petitions, if any pending, shall stand closed.
