ORDER:
This Writ Petition is filed for a Mandamus to declare the action of respondent No.4, in not allotting the essential commodities to the petitioner for distribution, as illegal and arbitrary.
It is the pleaded case of the petitioner that he has been working as the permanent fair price shop dealer from the year 1998 without any blemish and that under the local political influence, respondent No.4 has suddenly stopped allotment of essential commodities to the petitioner and has allowed third parties to distribute the essential commodities in the name of the petitioner’s fair price shop.
In my opinion, so long as the petitioner’s fair price shop authorization remains in force, respondent No.4 has no authority to deprive the petitioner of his right to distribute the essential commodities to the card holders. While cautioning respondent No.4 not to resort to such acts in future, respondent Nos.3 and 4 are directed to forthwith allow the petitioner to distribute the essential commodities from the month of January 2015. Respondent Nos.3 and 4 are cautioned that violation of this order will be viewed seriously.
Subject to the above direction, the Writ Petition is allowed.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.51489 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
