ORDER:
This Writ Petition is filed for a Mandamus to declare the action of respondent No.2 in initiating proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short ‘the Act’) against the petitioner.
Having regard to the allegations on which the proceedings under Section 6-A of the Act have been initiated against the petitioner, I decline to interdict the same. However, the petitioner has pleaded that though her authorization has not been suspended and only a show cause notice was issued by respondent No.3 on 27.11.2014, respondent No.4 has stopped allotting the essential commodities to her for distribution.
At the hearing, learned Assistant Government Pleader for Civil Supplies (Andhra Pradesh), has stated that he has no instructions as to whether the petitioner’s fair price shop authorization has been suspended or not.
In the light of the facts pleaded by the petitioner, respondent No.4 is directed to continue allotment of the essential commodities to the petitioner’s fair price shop for distribution so long as her authorization remains in force.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.51191 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
