HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.18747 OF 2014 ORDER:
Petitioner presented the deed of conveyance for transfer of ownership on the plot No.35A bearing house No.49/50/161 admeasuring 400 square feet in Sy.Nos.744/A, 745/B of Lakshmi Nagar, Kallur, Kurnool Municipal Corporation, Kurnool Sub-Division, Kurnool District. Petitioner contends that when he approached the Sub-Registrar, Kallur, Kurnool District (4th respondent) for receiving the deed of conveyance, the 4th respondent refused to entertain the deed of conveyance and refused to furnish market value and no reasons are assigned. In the circumstances, petitioner constrained to institute this writ petition.
2. Learned Government Pleader produced instructions furnished by the Joint Sub-Registrar-I, Kurnool, which, inter alia, disclose that no deed of conveyance was presented before him for registration and that there is no objection for registration.
3. Though petitioner asserted that he has presented the deed of conveyance, but no proof in support of the said contention is filed. In view of the assertion of the Joint Sub-Registrar, liberty is granted to the petitioner to present the deed of conveyance and as and when deed of conveyance is presented by the petitioner, the same shall be processed by the Joint Sub-Registrar (4th respondent) in accordance with the provision of the Indian Registration Act, 1908 and Indian Stamp Act, 1899 and to release the document if the same is otherwise in order.
4. Accordingly, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions if any pending in this writ petition shall stand cancelled.
