For Petitioner : Mr.R.Ramesh For respondent : Mr.C.Emalias, Addl. Public Prosecutor ORDER This petition has been filed to direct the respondent police not to harass the petitioner on the complaint preferred by the defacto complainant, without due process of law.
2. The learned Additional Public Prosecutor submits that based on the complaint given by one Manikandan notice was sent to the petitioner to appear before the respondent police on 19.02.2017 for enquiry.
3. Under such circumstances, blanket order of 'not to harass' cannot be passed. The petitioner is directed to appear before the respondent police on 13.03.2017 and co-operate with the enquiry and during the course of enquiry, he shall not be harassed. However, if any cognizable offence is made out, this order would not be a shield against the arrest of the accused.
4. With the above observation, this Criminal Original Petition is disposed of.
