Respondent Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus directing the respondent to take on file the petitioner's Application dated 20.06.2015 and direct the Respondent to refund to the petitioner Rs.11,97,000/- (after deducting the necessary statutory amount) for the unused court fee stamp papers bearing numbers 589439 to 589677, dated 07.01.2015 for Rs.5000/- each (5000 X 239 = 11,95,000) and A 623487 to 623490, dated 07.01.2015 for Rs.500/- each (500 X 4 = 2000/-) in accordance with law, within a certain period to be fixed by this Court.

Pleader ORDER The petitioner has filed the above writ petition to issue a Writ of Mandamus, directing the respondent to take on file his application dated 20.06.2015 and direct the respondent to refund him a sum of Rs.11,97,000/- (after deducting the necessary statutory amount) for the unused court fee stamp papers, in accordance with law, within a time frame.

Mr.Rugan, learned counsel appearing for the petitioner submitted that in spite of the petitioner's application dated 20.06.2015 for the refund of Rs.11,97,000/- (Rupees eleven lakhs and ninety seven thousand only) towards unused court fee stamp papers, the respondent has not considered the same and refunded the amount. The learned counsel further submitted that in similar circumstances, this court in W.P.No.13196 of 2015, dated 29.4.2015, directed the District Collector to consider the petitioner's representation, in accordance with law.
3. Mr.A.N.Thambidurai, learned Special Government Pleader, taking notice for the respondent submitted that following the earlier order passed by this court, a direction may be issued to the District Collector to consider the petitioner's application dated 20.06.2015, in accordance with law.
4. Having regard to the submissions made by the learned counsel on either side, taking into consideration the limited prayer sought for by the learned counsel for the petitioner, without expressing any opinion with regard to the merits of the case, I direct the respondent to consider the petitioner's application dated 20.06.2015 and pass orders, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
With this observation, the writ petition is disposed of. No costs.
