This Writ Petition was originally listed before the learned Single Judge, who was of the view that this is public interest litigation. In this Writ Petition, the petitioner has challenged order bearing Ref.No.C2/381/M/2013, dated 15.12.2013, by which, the District Collector has agreed for construction of a Church in plot Nos.10 to 11 on the assurance of Scheduled Caste people to maintain communal harmony.
In our view, there is no allegation that the District Collector has no power to accord permission, and according to us, in order to maintain communal harmony, the permission was granted for construction of the Church in accordance with law. When the temple and church are located side by side, the devotees will go to their respective religious places for performing prayers, of course, without disturbing their own sentiment. However, if there is any sound pollution problem, the same will be looked into by the Pollution Control Board of the local area. We do not find any reason to interfere with the impugned order.
The Writ Petition is accordingly closed. No costs. Consequently, pending miscellaneous petitions, if any, shall stand closed.
