Heard learned counsel for the parties.
This writ petition is filed alleging inaction on the part of the third respondent in not considering the petitioner’s representation dated 20.4.2011 seeking cancellation of pattas given to individuals in Sy.No. 5 situated at Peddapalli shivar and lay a bye-pass road in the same place. The aforesaid representation was apparently made on the basis of a memo issued by Tahsildar, Peddapalli which is filed at page 11 along with the writ petition which says that Survey No. 5 situated on the outskirts of Peddapalli is having Ac.3.22 gunts of land which was left over Sikham land.
Even if assuming that the petitioner’s representation is justified, he is not a single individual, but there are other individuals who were holding pattas in that area and the petitioner has not made them as party respondents in this writ petition. Hence on the ground of non-joinder of necessary parties, no relief can be granted to the petitioner as sought for in the writ petition. However, the petitioner is at liberty to notify the revenue authorities and persons holding pattadar passbooks on the aforesaid land and take appropriate steps in accordance with law, if law permits.
With the above observation, this writ petition is dismissed along with miscellaneous applications, if any. No costs.
