The learned counsel appearing for the petitioner sought the permission of this Court to withdraw the petition and has also made an endorsement to that effect. The learned counsel has also made an endorsement to withdraw the appeal. The learned counsel submitted that since the petitioner/appellant is withdrawing the petition even before the numbering of the First Appeal, Registry may be directed to refund the Court Fee paid by him.
2. Since the petitioner/appellant is withdrawing the petition even before numbering of the First Appeal, I direct the Registry to refund the Court fee paid by the petitioner/appellant to him.
3. In view of the same, the petition in C.M.P.No.18304 of 2017 stands dismissed as withdrawn. Consequently, the Appeal in A.S.SR.No.60208 of 2017 also stands dismissed as withdrawn. No costs.
