Respondents Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to consider the representation of the petitioner dated 8.10.2012 requesting appointment as Assistant Medical Officer Siddha Medicine in the Department of Indian Medicine Government of Tamil Nadu on the basis of his eligible qualification as B.S.M.S. as well as in accordance with G.O.Ms.No.175 School Education (M2) Department, dated 19.7.2007, which directs similar recruitment. ORDER
The petitioner has filed the present Writ Petition for the relief stated above.
2. According to the petitioner, based on G.O.Ms.No.175 School Education (M2) Department, dated 19.7.2007, he made a representation dated 8.10.2012 to the respondents requesting them for appointing him as Assistant Medical Officer Siddha Medicine in the Department of Indian Medicine Government of Tamil Nadu and the said representation has not been considered so far by the respondents.
3. The learned Special Government Pleader submitted that there was no such representation submitted by the petitioner to the respondents. If the petitioner submits a copy of the said representation, the same will be considered by applying the aforesaid G.O.,.
4. Considering the nature and limited scope of the prayer, without going to the merits of the matter, this Court directs the second respondent to consider the representation of the petitioner dated 8.10.2012 on merits and in accordance with law and also by applying G.O.Ms.No.175 School Education (M2) Department, dated 19.7.2007, within a period of 12 weeks from the date of receipt of a copy of this order.
5. The petitioner is directed to furnish a copy of the representation dated 8.10.2012 along with a copy of this order to the second respondent within a period of two weeks from the date of receipt of a copy of this order.
No costs.
6. With the above direction, the Writ Petition is disposed of.
