This Criminal Petition is filed to quash CC.No. 658 of 2010 on the file of Judicial Magistrate of First Class, Ananthapur.
2. This Court permitted petitioner on 04/4/2014 to take personal notice to Respondent No.1 by registered post with acknowledgement and to file proof of service. When the matter was listed on 29/4/2014 Advocate for petitioner took time to file proof of service, therefore, the matter was directed to be listed after summer vacation.
3. When the matter is listed after summer vacation, Advocate for petitioner again requested for time and on his request it is posted to 06/6/2014. Again on 06/6/2014 ten days time is requested and again the matter is listed today.
4. Today none appeared on behalf of petitioner and proof of service is not filed. Therefore, it is observed that petitioner has no interest in prosecuting the case.
5. Hence, Criminal Petition is dismissed for non-prosecution.
