Heard counsel for the petitioner and learned standing counsel appearing for the State respondents.
By means of the present petition under Art. 226 of the Constitution, the petitioner assails the order dated 5.11.2019, by which respondent no. 4-Regional Secretary, Madhyamik Shiksha Parishad, Meerut, has debarred the institution in question namely S.A.S. Janta Uchchtar Madhyamik Vidyalaya,Arjunpur, Etah from being an examination centre for a period of five years.
The present petition has been filed by the institution through its Principal. The Principal in ordinary course has no right to look into such type of affairs of the institution until and unless he is authorised by the committee of management to do so. No resolution to the above effect having been filed alongwith this petition, the learned standing counsel has rightly submitted that the Principal has no locus standi in the matter.
At this stage, counsel for the petitioner prays that he may be permitted to withdraw this petition with liberty to file petition afresh though the Committee of Management of the institution.
The prayer so made is accepted.
The writ petition is accordingly dismissed as withdrawn with the aforesaid liberty.
