Rvula Madhava Reddy and another … Petitioners And The State of Telangana Rep. by its Secretary, Legal Affairs, Legislative Affairs and Justice Law Department Secretariat Buildings Hyderabad and others … Respondents THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.35039 OF 2014 ORDER: (per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) A copy of the writ petition has been served in the office of the Government Pleaders of the State of Telangana, High Court Buildings, Hyderabad. Sri Gopireddy Chandra Sekhara Reddy, learned Government Pleader for Agriculture, appears and submits that he is not sure whether the matter has been served in his office or not. Even though he was shown the stamp and seal of the office, he is unable to state whether he has instructions to appear in this matter and all that he says is that he will check up and verify from his office and asks us to wait till then. We are unable to do so. We record that in spite of service, none appears in this matter for the State of Telangana.
The issue involved in the writ petition is squarely covered by our judgment dt.7.11.2014 in W.P. No.24877 of 2014 and batch.
In one of the similar matters, the learned Advocate General on the last occasion appeared and asked for an adjournment expressing his intention to contest the matter and prayed for time to file a counter. We passed a suitable interim order keeping the writ petition for hearing.
In this matter, we have recorded that no one appears to contest.
Taking note of the material placed before us, we are of the view that nothing is to be decided in this writ petition as everything has already been adjudicated in the batch.
Hence, we allow the writ petition and set aside the Government Order which is challenged herein. We direct the State Government to reinstate the petitioners in their earlier position.
Pending miscellaneous petitions, if any, shall stand closed.
There will be no order as to costs.
