JUDGMENT / ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents herein to provide electricity service connection to the petitioner's house as per his application under Receipt No.9387846/2013, dated 21.10.2013 as per Clauses 27(1)(1) and 27(2)(4) of the Tamil Nadu Electricity Distribution Code, within a reasonable time as may be fixed by this Court.
2.Heard the learned counsel appearing for the petitioner.
3.It is brought to the notice of this Court that though the respondent has already been served and the name of the Standing Counsel has also been printed in the cause list, there is no representation for the respondents.
4.It is the case of the petitioner that the petitioner is the owner of the property and that there is no rival claim by any one. Despite the fact that there is no dispute with regard to the ownership or any other impediment at the intervention of any one, the respondents have not extended service connection to the petitioner. It is in these circumstances, the learned counsel appearing for the petitioner submit that the petitioner is constrained to file the present Writ Petition. The learned counsel for the petitioner submitted that the petitioner will be satisfied, if a direction is issued to the respondents to consider his representation dated 24.03.2016, within the stipulated time. The petitioner has also submitted an application before the third respondent for getting electricity service connection.
5.Having regard to the limited scope of the prayer sought in this Writ Petition and the request now made by the learned counsel for the petitioner, without expressing any opinion on the merits of the matter, this Court is inclined to pass the following order:
The third respondent is directed to consider the petitioner's application for getting electricity service connection to his premises and his representation dated 24.03.2016 and pass orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
6.With the above direction, this Writ Petition is disposed of. No costs. Consequently, the connected W.M.P.(MD) 6896 of 2016 is closed.
