JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)
1. The matter was on Board on 15.6.2012. It was kept today to enable learned APP to verify the contents of the application. Ld. APP made available for perusal a fax received from P.S.I., Surendranagar City Police Station, wherein, it is stated that Dr. Rajesh L. Chachha was communicated on mobile phone and he stated that operation of Shri Girirajsinh Manubha Zala for removing implant arm left elbow and advised to admit on 18.6.2012.
2. The present application is filed by the uncle of the convict seeking temporary bail for a period of 30 days so as to get his father treated.
3. Rule.
Mr. Pujari learned APP waives service of rule on behalf of the respondent-State.
4. The applicant has been convicted for the offences punishable under section 302 of IPC to undergo life imprisonment as awarded vide judgment and order dated 22.3.2011 in Sessions Case No. 72/2009. By now, he has undergone 2 years, 10 months and 21 days as on 1.6.2012. He has enjoyed one furlough and reported in time. Nothing adverse is reported against the convict.
5. Taking into consideration the contents of the application, the same is allowed. The present applicant-convict is ordered to be released on temporary bail for a period of 25 days from the date of his release on his executing a personal bond of Rs. 5000/- (Rupees five thousand only) to the satisfaction of the Jail authorities.
6. The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute. Direct service permitted.
