1. Heard Mr.Pradeep Kumar Srivastav, learned counsel for petitioner, learned Standing counsel representing respondent-1 to 3.
2. Perused the record.
3. This Writ Petition under Article 226 of the Constitution of India has been filed for a writ of mandamus commanding respondent-3, Assistant Consolidation Officer, Sadar, District- Aligarh to mutate the name of petitioner regarding land purchased by him pursuant to Registered Sale Deed dated 22.07.2015/13.07.2015.
4. At the very outset, learned Standing Counsel has raised a preliminary objection by submitting that vendor-Shivdhra of sale deed dated 22.07.2015/13.07.2015d has not been impleaded as respondent in present writ petition. Consequently, present writ petition suffers from the vice of non-joinder of necessary and proper party.
5. When confronted with above, learned counsel for petitioner could not overcome the same.
6. In view of above, present writ petition is dismissed at this stage with liberty to petitioner to file afresh.
