HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.27689 of 2014 ORDER:
Vikas Educational Society has established Vikas Institute of Medical Sciences College of Physiotherapy and Vikas Institute of Medical Sciences College of Medical Lab Technology, in premises located in Guntur. Rural Institute for Community Education intend to take over this college and also shift the location of the College to Deenapur, Phirangipuram of Guntur District. Representation was submitted on 26.06.2014 to the Principle Secretary of Government, Department of Health, Medical and Family Welfare requesting transfer of management of Vikas Institute of Medical Sciences College of Physiotherapy and Vikas Institute of Medical Sciences College of Medical Lab Technology from Vikas Educational Society to Rural Institute for Community Education, Guntur, and also to change the name of the institute as Emmi College of Physiotherapy and Emmi College of Medical Lab Technology as well as re- location of the institute to Deenapur. The grievance of the petitioner necessitating institution of this writ petition is that so far, no orders are passed. On the contrary, schedule for admission of students into the above courses for the academic session 2014-15 have already commenced and unless a decision is taken, grave prejudice would be caused.
2. Learned Government Pleader submits that the Government has constituted high power committee to look into all issues concerning grant of permissions and shifting of such technical institutes and on receipt of the representation by the petitioner, report is called from the District administration. After the report is received, the matter would be placed before the High Power Committee.
3. Having regard to the schedule of admissions announced and since the representation is yet to be disposed of, the Writ Petition is disposed of, without expressing any opinion on merits, directing the Government to pass appropriate orders, as warranted by law, on due consideration of the representation submitted by the petitioner, dated 26.06.2014, regarding change of management as well as re-location and pass orders within a period of two (2) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
