RULE.
Learned Additional Public Prosecutor Ms. Ms. C.M. Shah waives service of notice of Rule for the respondent - State.
This application is preferred with the following prayers :-
"(A) This Hon'ble Court be pleased to allow this application.
(B) That This Hon'ble Court be pleased to modify condition no:5(g) of the conditions mentioned in order dated 11.04.2012 passed by this Hon'ble Court in Criminal Misc. Application No.3788 of 2012 and that this Hon'ble Court be pleased to extend time to surrender the passport till 23rd April, 2012 and condone the delay caused by the application in the same.
(C) That This Hon'ble Court be pleased to pass such other and further orders as the nature and circumstances of the case may require."
As per the order passed by this Court on 11.04.2012 in Criminal Miscellaneous Application No.3788/2012, the applicant was required to surrender his passport before the Trial Court on or before 18.04.2012, but because of some unavoidable circumstances, the applicant could not deposit the same and the passport was deposited on 23.04.2012. It is submitted by the learned Advocate appearing for the applicant that in light of the above, the above period of delay in surrendering of the passport may be condoned and time be extended.
Having heard learned Counsel for the applicant and in view of the averments made in this application, I deem it just and proper to extend the time to surrender the passport and also condone the above mentioned delay in surrendering of the same before the Trial Court.
With the aforesaid direction, this application stands disposed of. Rule made absolute to the aforesaid extent. Direct Service is permitted.
